Terms and Conditions

Article 1 General

1.1. Definitions
a.House of ID: the user of these terms and conditions;
b.Client: the natural or legal person who enters into an agreement with House of ID.
c. Agreement: the assignment agreement between the client and House of ID.
1.2 These general terms and conditions apply to all agreements that the client concludes with House of ID. The applicability of any purchase or other conditions of the client is explicitly rejected.
1.3 Any deviations from these general terms and conditions are only valid if they have been explicitly agreed in writing.
1.4If one or more of the provisions in these terms and conditions are invalid or should be destroyed, the remaining provisions of these terms and conditions remain fully applicable. House of ID and the client will then enter into consultation in order to agree new provisions to replace the invalid or annulled provisions, taking into account if and for as far as possible the purpose and scope of the original provision.

Article 2 Execution of the assignment

House of ID ensures that the assignment is carried out in accordance with the due care and quality requirements.

Article 3 Delivery time

3.1. The delivery times specified by House of ID cannot be considered a deadline.

The client must only use the information and documents obtained in the conduct of his own business (in the case of a legal person) or in private life (in the case of a natural person). It is not permitted to make this information and documents public, to reproduce or to sell in any form whatsoever.

Article 5 Price

5.1. The prices quoted are in euros and include VAT.
5.2. Prices quoted in a general sense (such as prices mentioned in previous orders, quotes, on the website or in advertisements) can be changed by House of ID at any time.

Article 6 Payment

6.1. Payment must be made within 14 days after the invoice date, in a manner to be indicated by House or ID on the invoice.

6.2. In the event of not or late payment, the client will owe statutory interest from the due date of the invoice to the date of full payment of the outstanding amounts. Furthermore, all judicial and extrajudicial costs to collect are for the account of the client.

6.3 If the client decides to remove the property for sale from the sale, the claim of House of ID on the client remains. The client also undertakes to pay the House of ID invoice in Calpe on time.

Article 7 Liability

7.1. House of ID cannot guarantee the complete accuracy and completeness of the information and documents provided. House of ID is therefore not liable, except for intent or gross negligence, for damage that has arisen as a result of incorrectness, incompleteness or unlawfulness of the content of the service (s) provided by House of ID.

7.2. House of ID is never liable for the consequences of the use of information and documents provided. House of ID does not guarantee that the services provided will deliver or achieve the desired result.

7.3. The Client ensures that all data, of which House of ID indicates that they are necessary for the execution of the assignment, is provided to House of ID in a timely manner. If the client has not provided this information, House of ID is not liable for the resulting damage. If the information required for the execution of the assignment is not provided to House of ID in time, House of ID has the right to suspend the execution of the assignment.

7.4. House of ID is not liable for damage of any nature whatsoever, because House of ID started from the incorrect and / or incomplete data provided by the client, unless the inaccuracy or incompleteness should have been known to House of ID.

7.5.House of ID is not liable for consequential damage, lost profit, missed savings and damage due to business interruption.

7.6. If House of ID should nevertheless be liable, its liability is limited to at most the invoice value of (the part of) the assignment agreement from which the liability arises.

7.7. All claims against House of ID that have not been submitted to House of ID within 2 years after their origin expire due to expiration.

Article 8 Force majeure

8.1. In the event that the execution of the assignment is impossible due to force majeure, House of ID is released from its obligations under the agreement.

8.2. Force majeure is also understood to mean a circumstance over which House of ID cannot or cannot reasonably have any influence.

Article 9 Complaints procedure

9.1. Complaints must be made known to House of ID in writing or electronically within 30 days of receipt of the delivered goods, failing which the possibility of submitting a complaint will lapse.

9.2. If a complaint is justified, House of ID will still perform the work as agreed, unless this has become demonstrably pointless for the client. The latter must be made known in writing or electronically by the client. If it is no longer possible or useful to carry out the agreed work, House or ID will adjust the invoice to a lower amount or to zero. In that case House of ID will only be liable within the limits of article 7 of these general terms and conditions.

Article 10 Miscellaneous

10.1.House of ID is authorized at all times not to handle an assignment.

10.2.If the client has applied for suspension of payment or is in a state of bankruptcy, House of ID is entitled to terminate the agreement immediately.

10.3. House of ID is obliged to maintain the confidentiality of data which it receives from the client, except to the extent that any statutory regulation requires House of ID to communicate.

10.4. House of ID has the right to remove and destroy files and all documents contained therein, including documents belonging to the client, from the archives without further notice, if 3 years or more have passed after House of ID has carried out the assignment .

Artikel 11

11.1 In the event of renting furniture and / or accessories from House of ID, the client will ensure that they are used correctly and will prevent damage and / or theft of those furniture and / or accessories as much as possible. The duration of the rental of furniture and / or accessories is laid down in the assignment agreement.

11.2 The utilities, namely gas, water and electricity, will be present in the home by and at the expense of the client and can be used by House of ID.

11.3 In the event that the furniture and accessories are damaged or stolen due to the negligence of the client, the damage ensuing therefrom shall be borne by the client.
